PUNE: “I worked in an IT company for seven years. I thought that I would get all my dues while leaving. But after I resigned, I have not been paid three months’ salary, gratuity, PF and full and final settlement is yet to be done. The company owes me ₹18.73 lakh. I have approached company officials, labour commissionerate, police and court to seek redressal of my grievances,” said Rajnish Kumar.

Kumar was working in an IT company for seven years. The company employs 450 people in Pune. Kumar resigned from the company for personal reasons on November 3, 2022.
“Since I wanted to leave the job, I checked whether the PF had been deposited. I was surprised when I came to know that PF of five months had not been deposited. I enquired with the company,” he said. He was immediately removed from the company.

Since he did not get three months’ salary, gratuity, PF and full and final settlement, he lodged a complaint with the labour treatment. A meeting was organised thrice to allow the company to present its case but the representative of the company did not attend any of the meetings. Kumar approached the police. However, since his complaint was not registered, he lodged a private complaint in the court. The court has recently given its judgement in the case and has ordered the police to register a complaint and carry out a probe.

“I had resigned from the job for some personal reasons. However, there was an anomaly with PF, so I enquired with the police. After I sent an email to the company about the PF, my service was terminated. The company owes me ₹18.73 lakh. Since I was cheated, I approached the court,” said Rajnish Kumar.

“Some IT companies hire an individual for three to 11 months and later, terminate his services. The PF is deducted from the salary but it is not deposited in their accounts. Such irregularities are happening in various IT companies. We did a follow-up in Kumar’s case and approached the court,” said Harpreet Saluja, President of Nascent Information Technology Employees Senate
