Bombay HC to Hear Edelweiss Officials’ Pleas to Quash FIR in Nitin Desai Suicide Case

Mumbai, August 9: The Bombay High Court has accepted the pleas of Rashesh Shah, Chairman of Edelweiss Financial Services, and Raj Kumar, Managing Director and CEO of Edelweiss Asset Reconstruction Company Limited, to quash the FIR filed against them regarding the alleged abetment to the suicide of renowned Indian art director Nitin Desai.

A Division bench comprising Justices Nitin Sambre and RN Laddha has scheduled the hearing for August 11, following a request for an urgent hearing made by Senior Advocate Amit Desai.

The petitioners have requested the Court to provide interim relief in the form of ‘no coercive action’ and to halt the investigation until the hearing of their pleas.

The Raigad police had previously registered a case of abetment to suicide in connection with Nitin Desai’s death, and a notice was sent to the MD of Edelweiss Company.

On August 4, the Raigarh Police had filed a case in the Nitin Desai suicide case, naming five individuals, including officials from the ECL Finance Company and Edelweiss. The case was filed under Sections 306 (abetment to suicide) and 34 (common intention) of the Indian Penal Code (IPC).

Nitin Desai, a national award-winning art director, was discovered deceased in his studio on August 2. An audio note left behind by him implicated Bansal, Shah, and three others in his financial difficulties, as reported by the police.

Following this, Nitin Desai’s wife, Neha, lodged a written complaint with the Raigad police in Maharashtra, leading to the filing of an FIR at the Khalapur police station.
