FPCE Advocates for Oversight: Calls for Dedicated Unit within MoHUA to Monitor State RERAs

The Forum for People’s Collective Efforts (FPCE) has urged the Ministry of Housing and Urban Affairs (MoHUA) to establish a dedicated unit within the ministry to oversee the operations of all State Real Estate Regulatory Authorities (RERAs). This call comes in response to instances of non-compliance, particularly by authorities in Maharashtra and Uttar Pradesh, raising concerns about the persistence of pre-RERA practices.

Practices such as advertisements allowing modifications at developers’ discretion, which contradict the Real Estate (Regulation and Development) Act, 2016, have been highlighted by FPCE. These practices undermine the transparency objectives of RERA, posing a threat to the informed decision-making process of homebuyers.

FPCE has proposed the creation of a committee to scrutinize the existing infrastructure concerning transparency and reliability. This committee aims to aid informed decision-making regarding RERAs and ensure adherence to the stipulations of the Real Estate Act.

Abhay Upadhyay, President of FPCE, expressed concerns about the current implementation of RERA, stating, “Our concerns confirm our belief that the effectiveness of RERA is crucially dependent on the commitment and diligence of the regulatory authorities in implementing its provisions in both letter and spirit, which is missing at present.” He further added, “It is clear that the authorities have misplaced priorities which are leading to neglect of crucial aspects.”

FPCE representatives emphasized the necessity for regular meetings among state RERAs to solicit feedback and implement necessary course corrections. These meetings would facilitate collaboration and the sharing of best practices to enhance the overall effectiveness of RERAs.

During a recent meeting convened by MoHUA, FPCE delegates highlighted various concerns regarding the functioning of state RERAs. They specifically called for the formation of a committee to study the present infrastructure of transparency and reliability on all state RERA websites.

The meeting, convened by MoHUA, aimed to evaluate the efficiency of RERAs across multiple dimensions, including transparency, accountability, information dissemination, and grievance redressal.
