DSK case: Bombay HC orders public prosecutors to submit affidavit about efforts made to recover depositors’ money

PUNE: The Bombay High Court has issued an order to the public prosecutors that a detailed affidavit regarding efforts made to recover depositors’ money in connection with the FIR registered against builder Deepak Sakharam Kulkarni (DSK) should be submitted. The orders were issued by a bench of Justices Sharmila Deshmukh and AS Gadkari.

The order states that the affidavit should be submitted by October 11. Ad Chandrakant Bidkar has submitted a criminal petition on behalf of the depositors which demands that no property of DSK should be excluded from the process of seizure till the depositors, who have been cheated, get back their money.

The court had issued an order to the police seeking information about the seizure and auction of DSK’s properties. Accordingly, the police had submitted an affidavit. It stated that so far, 335 immovable properties of DSK had been seized and the police have also seized 46 vehicles belonging to him and his companies.

An affidavit submitted by the EoW states that of them, 13 vehicles have been auctioned. Meanwhile, Ad Bidkar brought it to the court’s notice that the depositors were yet to receive their money and the court issued the order.

Ad Chandrakant Bidkar, the lawyer of depositors, said, “Many applications have been made on behalf of depositors seeking return of their money. The court has issued orders on 14 applications. Depositors are waiting to get back their money. A follow-up is being done in the court. The depositors are upset that the process of getting back their money is taking a lot of time.”
