Maharashtra Government Approves Groundbreaking Policy for Transgenders, Paving the Way for Equality and Inclusion

In a significant stride towards inclusivity, the Maharashtra government has greenlit a groundbreaking policy aimed at fostering equal rights and addressing the challenges faced by the transgender community. The comprehensive 28-page policy outlines reforms in education, healthcare, and proposes a dedicated redressal system to combat prejudice and discrimination often experienced by transgender individuals.

The policy advocates the establishment of a Transgender Protection Cell under the supervision of the director-general of police (DGP) or the nomination of a dedicated officer at the state level to address cases related to the transgender community. It further suggests designating a police officer at each police station to investigate cases involving transgenders, enhancing their access to justice.

To ensure equal rights and combat discrimination, the policy proposes the constitution of a medical board at the district level, providing financial support for gender-affirming surgeries, and free gender-affirming surgeries at government hospitals.

In the realm of education, the policy addresses barriers faced by transgender individuals, emphasizing the need to eradicate discrimination in educational institutions. It recommends the issuance of directives to all institutions under state and central government jurisdiction, urging stern action against bullying, harassment, and violence towards transgender students. The policy advocates the creation of dedicated cells to address complaints related to discrimination, prejudice, and violence against transgender students.

The policy also aims to promote inclusivity in civil service examinations by introducing a category called ‘Third Gender,’ allowing transgenders to participate. In workplaces, it suggests the establishment of dedicated counselling or support centers, prioritizing transgender individuals in skill development training and professional development.

Additionally, the policy proposes making transgenders eligible for pensions in cases where the surviving family member of a deceased government employee is transgender. It calls for the establishment of a Transgender Commission as mandated by the Transgender Persons (Protection of Rights) Act, 2020, and encourages insurance companies to consider transgender certificates issued by appropriate authorities.

Furthermore, the policy envisions independent toilets for transgenders at public places and provides a platform for them to showcase their cultural talents, fostering a more inclusive society.
