Delhi High Court Pushes for Equal Opportunity: Male Nurses at Borders?

The Delhi High Court has taken a significant step towards advocating gender equality within the armed forces. During proceedings on Tuesday, the court questioned the practice of exclusively deploying female nurses in military establishments, highlighting the need for equal opportunity in such roles. The case revolves around an alleged unconstitutional practice, which has long been a point of contention.

A bench comprising Chief Justice Satish Chandra Sharma and Justice Sanjeev Narula presided over the hearing regarding this matter. Additional Solicitor General Aishwarya Bhati, representing the Centre, defended the existing practices in the Army, citing their basis in long-standing traditions.

However, the bench made a compelling argument by drawing attention to recent legislative developments. It pointed out that the government had recently enacted a law providing 33 percent reservation for women in both the Lok Sabha and state assemblies. This legislative move underscores the nation’s commitment to gender equality and representation in various sectors.

Furthermore, the bench referred to the consistent stance of the Supreme Court, which has reiterated the importance of eliminating gender bias and promoting equal opportunities for all. In light of these legal and legislative precedents, the Delhi High Court emphasized that gender should not be a determining factor in the selection and deployment of nursing staff within the armed forces.

As a result, the court’s intervention signals a pivotal moment in advocating for gender neutrality and equal opportunities within the armed forces. The case has been scheduled for further hearings in November, indicating the court’s commitment to addressing this issue and ensuring that gender equality prevails in all aspects of the armed forces’ operations.
