Breaking New Ground: Peru Mandates ISPs to Compensate Users for Service Disruptions

Peru’s telecommunications regulatory authority, OSIPTEL, has ushered in a pivotal change in the country’s internet service landscape. Henceforth, all internet service providers (ISPs) must extend financial compensation to users affected by outages in their fixed internet services. This compensation, in addition to the standard refund, aims to hold ISPs accountable for service reliability and user satisfaction.

A New Era of Accountability

In a momentous decision published in the official gazette El Peruano, OSIPTEL has instituted a rule that directs ISPs to offer financial restitution to users experiencing fixed internet service interruptions. This compensation can be up to four times the value of the standard refund, as stipulated by the Supervisory Body of Private Investment in Telecommunications (OSIPTEL).

Varied Compensation Tied to Outage Duration

The quantum of compensation will be contingent on the duration of the service interruption. Users impacted by service disruptions attributed to their provider will now receive not just a standard refund for the affected period but also financial compensation amounting to up to four times the value of the refund.

Promoting User-Centric Accountability

The regulatory authority OSIPTEL has embraced this measure as a catalyst for service providers to internalize the impact experienced by subscribers due to service outages. It serves to heighten ISPs’ incentive to proactively reduce interruptions and provide timely, effective resolutions when outages occur. This augments the quality and reliability of telecommunications services provided to users.
