Upholding Equality in Marriage: Uttarakhand Committee Proposes Revolutionary Changes


In a groundbreaking move towards achieving gender equality, the committee responsible for drafting the Uniform Civil Code (UCC) in Uttarakhand has recommended granting wives the same right to divorce as husbands. The committee’s report, submitted to Chief Minister Pushkar Singh Dhami, outlines key recommendations that aim to bring about significant changes in marriage and divorce laws in the state.

Key Recommendations:

1. Equal Divorce Rights: The committee proposes a revolutionary change by suggesting equal grounds and basis for divorce for both husbands and wives. This move aims to ensure that both parties have equal legal standing when seeking the dissolution of their marriage.

2. Prohibition of Polygamy: Among the recommendations is the prohibition of polygamy, reinforcing the principle of monogamous marriages across all communities. This step is taken to promote fairness and equality in marital relationships.

3. Mandatory Marriage Registration: Emphasizing the importance of legal documentation, the report recommends making marriage registration mandatory for all citizens. This step ensures proper recognition and documentation of marital bonds, streamlining legal processes.

4. Uniform Civil Code: The committee advocates for the enforcement of a Uniform Civil Code (UCC) to standardize personal laws related to marriage, divorce, inheritance, and adoption across all religions. This move aims at fostering national integration and promoting gender equality.

5. Minimum Age of Marriage and Live-in Relationships: To protect the rights of individuals, the committee suggests setting the minimum age of marriage for girls at 18 years across all religions. Additionally, provisions for live-in relationships are included, requiring a declaration from the involved partners.

Legislative Actions: The government is poised to introduce the UCC bill in the upcoming legislative assembly session starting from February 5th.
