Supreme Court Takes Up Covishield Vaccine Side-Effects Petition: Calls for Expert Panel and Compensation

The Supreme Court of India has stepped into the fray surrounding the Covishield COVID-19 vaccine, manufactured by the Serum Institute of India in collaboration with AstraZeneca and Oxford University, following concerns over rare side-effects associated with its administration. While a definitive hearing date is yet to be scheduled, Chief Justice DY Chandrachud has acknowledged the gravity of the situation, signaling the court’s intention to address the matter promptly.

Demand for Investigation and Compensation

The petition before the Supreme Court highlights the pressing need for an expert panel to delve into the reported rare side-effects linked to the Covishield vaccine. The petitioner advocates for comprehensive scrutiny of not only the documented side-effects but also potential risks that may have gone unnoticed. Furthermore, there are calls for the oversight of this investigation by a retired Supreme Court judge to ensure transparency and impartiality.

The Thrombosis Concerns

Of particular concern are instances of vaccine recipients experiencing disability, allegedly stemming from a rare condition known as thrombosis with thrombocytopenia syndrome (TTS). This condition manifests as blood clots coupled with a reduced platelet count and has been associated with the administration of the AstraZeneca COVID-19 vaccine. The gravity of the issue is underscored by legal action initiated in the United Kingdom by Jamie Scott, who claims to have suffered a permanent brain injury following a blood clot post-vaccination.

Balancing Benefits and Risks

Despite the emergence of these concerning reports, regulatory bodies worldwide, including the World Health Organization (WHO), maintain that the benefits of COVID-19 vaccination far outweigh the exceedingly rare risk of severe side-effects. Covishield, utilizing a viral vector platform based on a modified chimpanzee adenovirus (ChAdOx1), stands as a testament to scientific innovation in combating the pandemic. This platform effectively introduces the COVID-19 spike protein into human cells, triggering an immune response without causing illness.

Charting the Path Forward

As the Supreme Court gears up to address this pivotal issue, the spotlight remains on the need for a balanced approach that prioritizes public health while addressing legitimate concerns regarding vaccine safety. The establishment of an expert panel, coupled with the provision of compensation for affected individuals and families, underscores the commitment to transparency, accountability, and the well-being of citizens.

The upcoming proceedings hold the promise of illuminating insights and decisive action, reaffirming the judiciary’s pivotal role in safeguarding public health and upholding the principles of justice and equity amidst the ongoing battle against the COVID-19 pandemic.
