In the Fog’s Wake: Navigating Compensation for Airport Flight Disruptions

As dense fog continues to disrupt flights at Delhi Airport, leaving over 100 flights delayed or canceled, passengers find themselves grappling with the aftermath. Understanding your rights during such disruptions is crucial, and the government has issued directives to address the flight crisis effectively. This article outlines the steps to claim compensation for flight delays, cancellations, and denied boarding incidents.

Flight Crisis Unveiled:

The recent crisis at Delhi Airport, fueled by dense fog covering North India, has led to the disruption of over 100 flights. In response, the government has issued directives to airport authorities, emphasizing effective measures to address the flight crisis. A warning against unruly behavior towards airline staff has also been issued following a viral video depicting an IndiGo pilot being assaulted.

Flight Cancellations and Compensation:

Airlines facing cancellations must either arrange an alternative flight within two hours or provide a refund. For cancellations within a fortnight and up to 24 hours before departure, passengers are entitled to a refund and compensation ranging from Rs 5,000 to Rs 10,000 based on the flight time.

Passenger Rights During Delays:

  • For Delays Less Than a Day: Airlines must provide meals and refreshments at the airport.
  • For Delays More Than a Day: Airlines are obligated to provide hotel accommodation with transfers.

However, it’s crucial to note that airlines have no obligation to compensate if the delay is caused due to extraordinary circumstances.

Claiming Compensation – Steps:

  1. Document Everything: Keep detailed records of all communication, boarding passes, tickets, and related information.
  2. Contact the Airline: Inform the airline, inquire about entitled compensation, and obtain written confirmation of assistance.
  3. File a Complaint: If dissatisfied, file a complaint with the airline and the DGCA, including all relevant documentation.
  4. Seek Legal Assistance: If the airline denies rightful compensation, consider seeking legal assistance or contacting a consumer rights organization.

Passenger Rights in Case of Denied Boarding:

  • Stay Informed About Denied Boarding: Passengers have the right to be informed about denied boarding with reasonable grounds.
  • Compensation for Denied Boarding:
    • If an alternative flight is offered within 24 hours, compensation is 200% of the basic fare (plus fuel charge) with a max of Rs 10,000.
    • If the passenger declines an alternative flight, compensation is 400% of the basic fare (plus fuel charge) with a max of Rs 20,000. Additionally, the passenger is entitled to a refund of the full ticket value.
