Over 10,000 Document Registrations Violated Maharera and Fragmentation Acts in Pune: Revenue Minister Takes Action

Pune, August 24, 2023: In a concerning revelation, it has come to light that over 10,000 document registrations in Pune have violated the Maharera and Fragmentation Acts. Revenue Minister Radhakrishna Vikhe Patil, in response to this issue, has declared the state’s commitment to taking appropriate actions to rectify the situation.

Minister Patil stressed the importance of adhering to regulations set by the competent authority when registering apartments under these acts. He emphasized that the necessary Maharera registration number should be included in the registration. A circular issued by the Inspector General of Registration further emphasized the requirement to register transactions involving plots approved for sale after layout approval and subsequent demolition.

Surprisingly, Pune city alone witnessed the registration of 10,561 units that violated both of these legal provisions. To address this serious concern, the state government has taken swift disciplinary measures against 44 officers and staff members involved. This action has led to the suspension of 11 sub-registrars, transfers of other officials, and the initiation of departmental inquiries.

In parallel, an update has emerged regarding a petition filed in the Aurangabad Bench of the Bombay High Court concerning the Fragmentation Act. A circular issued by the Inspector General of Registration was nullified by the court. Despite the state government’s efforts to pursue a review petition, success has remained elusive. Consequently, the matter has been elevated to the Supreme Court, awaiting a final verdict.

Acknowledging the concerns raised about the registration of documents in violation of Maharera and the Fragmentation Act, Vikhe Patil assured the enactment of appropriate measures. The examination of both reports on the breach of the Fragmentation Act has revealed significant irregularities. The government is determined to take swift and decisive action to address this issue promptly. The report from Registration Office No. 3 is pending and will be made available in the near future, as stated by Revenue Minister Radhakrishna Vikhe Patil.
