Pune IT Professional Seeks Legal Action After Unpaid Salary and PF Contributions

Pune, 10th June 2023: Rajnish Kumar, an IT professional, is pursuing legal action against his former employer in Pune after not receiving his unpaid salary, gratuity, provident fund (PF) contributions, and full and final settlement. Kumar, who had worked for the company for seven years, expressed his disappointment at having to go through the labor commissionerate, police, and court processes to resolve this issue.

Kumar had been employed at a well-known company in Pune with a workforce of 450 employees. After resigning from his job on November 3, 2022, due to personal reasons, he discovered that his PF contributions for the past five months had not been deposited. When he raised the issue with the company, he was unexpectedly terminated.

Faced with the non-payment of his three months’ salary, gratuity, PF contributions, and full and final settlement, Kumar filed a complaint with the labor department. Despite three meetings being scheduled to address the matter, the company representative failed to appear each time. Frustrated by the lack of progress, Kumar approached the police, but his complaint was not registered. As a result, he took the matter to court and recently received a verdict in his favor, ordering the registration of a case and a subsequent investigation.

“After resigning from the company for personal reasons, I discovered that my PF contributions had not been deposited. Instead of addressing my concerns, the company terminated my employment. Additionally, I am owed a total of Rs 18,73,177 by the company. Feeling deceived, I sought legal recourse,” shared Rajnish Kumar, the IT professional.

Harpreet Saluja, President of the Nascent Information Technology Employees Senate, an organization for IT employees, commented on the prevalence of cases where employees’ PF contributions are deducted but not deposited. “In Kumar’s case, we provided assistance, following up on the matter and ultimately filing a court case,” stated Saluja.
