Mahatma Gandhi Smarak Files PIL in Bombay HC to Prevent Defamation of Historical Figures

Pune, August 7, 2023: The Mahatma Gandhi Smarak organization in Pune has taken a significant step in the fight against defamation of historical figures. Activists associated with the organization have filed a Public Interest Litigation (PIL) in the Bombay High Court, seeking the court’s intervention to establish guidelines that prevent the defamation of revered historical figures. This move comes in the wake of a derogatory statement made by Hindutva leader Sambhaji Bhide against Mahatma Gandhi.

The PIL, filed on August 3, 2023, by petitioners including Dr. Kumar Saptarshi, Anwar Rajan, and Sandip Barve, aims to address the limitations of Indian Penal Code (IPC) Sections 499 and 500, which deal with defamation cases. The activists argue that these sections have limited scope when it comes to protecting historical figures from defamatory statements.

The crux of the petition lies in the need for specific guidelines to prevent the spread of defamatory statements about historical figures through various media and communication channels. The activists believe that such statements not only tarnish the legacy of these revered figures but also have the potential to harm society and the nation as a whole.

In a time when public discourse and opinions can easily reach a wide audience through social media and other platforms, ensuring the dignity and respect of historical figures becomes crucial. Defamation of iconic personalities can have far-reaching consequences and negatively impact the values they stood for.

The PIL seeks the Bombay High Court’s guidance in framing guidelines that strike a balance between freedom of speech and the protection of historical figures’ reputations. As the legal process unfolds, it will be interesting to see how the court addresses this important issue and the implications it holds for preserving the integrity of historical figures in public discourse.
