Pune : In a tragic incident that unfolded on September 21, 2022, a labourer lost his life in a fatal fall while working on the 10th floor of the under-construction ‘Majestique Marbella’ housing project in Kharadi. The victim, Vishwanath Khudiram Vishwas, had been performing centring work when the accident occurred, raising concerns about safety measures on the construction site.
Delayed Legal Proceedings: After almost a year and a half of investigation, Pune police have finally registered a case related to the incident. The delay in initiating legal proceedings has sparked doubts and questions about accountability. The case has been filed under IPC 304 (A) (causing death by negligence) and 34 (common intention) against contractor Faheem Usman Sheikh and subcontractor Deepan Dewas Samajdar.
Tragic Details of the Incident: Vishwanath Vishwas, a resident of Kharadi, was working alongside colleagues on the tenth floor when he lost his balance and fell into a duct during centring work. The inadequate safety nets on multiple floors contributed to a direct fall from the tenth floor to the first, resulting in fatal injuries.
Identifying Lapses in Safety Measures: The investigation uncovered potential lapses and faults in safety measures at the construction site, particularly in the quality of safety nets. The substandard nets on several floors were identified as a contributing factor to the tragic incident.
Legal Action and Complaint: A case was registered against contractor Faheem Usman Sheikh and subcontractor Deepan Dewas Samajdar based on a complaint filed by Abhijit Khudiram Vishwas, a relative of the deceased. The registration of the case took place at the Chandan Nagar police station.
This case highlights the critical importance of stringent safety measures at construction sites to prevent tragic accidents and underscores the need for prompt legal actions in such cases.
