High Court Directs PMC to Demolish Unauthorized Structures Near HEMRL; Landmark Decision Upholds Regulations

A legal dispute over unauthorized construction near the premises of the High Energy Material Research Laboratory (HEMRL) in Pashan along the Mumbai-Pune Highway has reached a resolution, with the Pune Municipal Corporation (PMC) receiving directives from the High Court. The court has imposed fines of 1 Lakh rupees each on the illegal structures, emphasizing the need to uphold regulations around HEMRL, known for its research in high explosives and advanced technologies vital for national security.

Despite the sensitive nature of HEMRL’s operations under the Ministry of Defence, a stretch of land within a 500-meter radius witnessed unauthorized construction, prompting legal action. The High Court bench, comprised of Justice GS Patel and Kamal Khata, not only fined the illegal structures but also imposed fines on petitioners for misleading the court, further directing the PMC commissioner to utilize the collected fines for social work.

Expressing concern over these encroachments, HEMRL consistently urged the PMC to take action and demolish the unauthorized buildings. The legal battle intensified when six local businesses contested the Municipal Notice in the High Court in November 2023. However, the recent court decision marks a significant victory for the Municipal Corporation, emphasizing the importance of upholding regulations in areas of strategic significance.
