First Class Magistrate Court Directs Pune Police to File FIR in Rs 2.2 Crore Fraud Case

The First Class Magistrate Court has issued a directive to the Pune Police, ordering them to file a First Information Report (FIR) against four individuals accused of defrauding a businessman of Rs 2.2 crore. The plaintiff in the case is Parikshit Nampurkar, while the accused parties are Sanjog Mahadev Deshmukh, Laxman Armani, Dilip Sadashiv Chavan, and Dr. Mahadev Ramachandra Deshmukh. According to Vijay Singh Thombre, the advocate representing the plaintiff, Nampurkar is the owner and manager of two companies, Vival Project Private Limited and Vision Consultancy.

In December 2020, Nampurkar had a business-related meeting with Dr. Mahadev Deshmukh, during which the latter provided false information. Dr. Deshmukh claimed to own two educational complexes under the name of Shri Chhatrapati Shivaji Education Society and the Dhanvantari Medical College, stating that they were facing financial difficulties due to the COVID-19 pandemic. Dr. Deshmukh then approached Nampurkar and requested an investment in the educational organization. In January 2022, Dr. Deshmukh, along with Sanjog Mahadev Deshmukh, Laxman Armani, and Dilip Sadashiv Chavan, held a meeting with Nampurkar at Dr. Deshmukh’s office in Aranyeshwar.

During the meeting, Nampurkar was presented with various documents pertaining to the educational institution and was urged to invest in it. Trusting Dr. Deshmukh, Nampurkar made a payment of Rs. 2,21,68,684. However, he later discovered that Dr. Deshmukh had been arrested by the Enforcement Directorate (ED). When Nampurkar questioned Sanjog Deshmukh and the other accused about this development, he received vague responses. Further investigation into Dr. Deshmukh’s background revealed that the educational complexes had previously been sold to an individual named Satish Patil. Nampurkar then realized that a case regarding the complexes was already subjudice in the Dharwad High Court, prompting him to file a complaint with the police.

Unfortunately, the police did not take Nampurkar’s application seriously, prompting him to seek legal recourse. Through his advocate, Thombre, Nampurkar approached the First Class Magistrate Court. During the court hearing, Thombre submitted the plaintiff’s bank statement and other essential documents relating to the funds transferred to the accused. Taking into account the evidence presented, Akshi Jain, the Magistrate of the First Class Court, ordered the Pune Police to register a case and conduct a thorough investigation.

The court acknowledged the authenticity of the evidence provided by Thombre, thereby compelling the police to take immediate action. The filing of an FIR marks a significant step towards obtaining justice for Nampurkar and ensuring a thorough investigation into the alleged fraud.
