Delhi Consumer Court Rules in Favor of Car Owner: Maruti Dealer Ordered to Pay Rs 2 Lakhs for Defective Vehicle

In a recent ruling, the Delhi State Consumer Disputes Redressal Commission has mandated a Maruti Suzuki dealer in Delhi to pay Rs 2 lakhs in compensation to a car owner, Arun Kumar, whose brand-new Wagon R experienced a malfunctioning speedometer within 24 hours of purchase.

Arun Kumar, the aggrieved consumer, purchased the vehicle from a showroom in Amar Colony, Lajpat Nagar, in May 2012, only to discover that the speedometer was providing inaccurate readings. The commission attributed the defects to staff negligence within the first week of the car’s purchase.

Acknowledging the mental agony experienced by Kumar, the commission highlighted the disappointment consumers face when their newly acquired vehicles break down shortly after purchase.

Kumar’s attempts to address the issue with the showroom were met with delays and alleged attempts to conceal damages. The staff assured a swift repair, but Kumar later discovered additional damages to his car, including paint smudges, a broken rim area, and a painted-over left side. The company claimed the car had a minor collision, which Kumar contested, stating that the vehicle was intentionally delivered at night to prevent him from inspecting the damages.

Initially, a district consumer court ordered the replacement of Kumar’s vehicle in 2018. Following an appeal to the Delhi State Consumer Disputes Redressal Commission, the compensation was reduced to Rs 2 lakhs, citing the absence of expert testimony or supporting documentation to establish the manufacturing flaw.

This ruling sets a precedent for consumer protection, emphasizing the responsibility of dealerships to deliver defect-free vehicles and address concerns promptly.
