WinZO and Hike Engage in Legal Battle Amid Allegations of IP Violation

The legal feud between gaming platforms WinZO and Hike has escalated, shedding light on a contentious dispute over alleged intellectual property (IP) violations and strategic disagreements. The conflict, which dates back several years, has now reached a critical juncture as the Delhi High Court intervenes, granting WinZO’s plea for arbitration and the appointment of an arbitrator.

At the heart of the dispute lies WinZO’s accusations against Hike Singapore and its Indian subsidiary, Hike Private Limited, of launching a competing app named ‘Rush’ in November 2020. WinZO contends that ‘Rush’ replicates several key features of its own app and infringes upon its IP rights. The allegations extend to claims of confidential information misuse and unauthorized imitation of WinZO’s proprietary match-making algorithm.

In response, WinZO filed a petition under Section 9 of the Arbitration and Conciliation Act, 1996, seeking interim reliefs against Hike, which included restraining the respondents from using its confidential information or intellectual property. The Delhi High Court’s recent order directing the submission of source codes and algorithms from both parties underscores the gravity of the legal battle.
