Peugeot Motorcycles Italia Fined Over Patent Infringement

An Italian court has ruled that Peugeot Motocycles Italia, owned by Mahindra, has violated a patent held by the Piaggio Group, resulting in a substantial fine.

The Corte di Cassazione, Italy’s highest court of appeal, recently dismissed an appeal filed by Peugeot Motocycles SAS and Peugeot Motocycles Italia. This decision confirmed the Milan Court of Appeal’s earlier judgment, which upheld an initial ruling by the Court of Milan. The courts determined that Peugeot had infringed upon the Italian portion of a European patent owned by Piaggio & C. S.p.A.

The Patent in Question

The patent in dispute pertains to a control system that enables a three-wheel vehicle, such as the Piaggio MP3, to tilt sideways like a traditional motorcycle. This innovative system allows for enhanced stability and maneuverability, distinguishing Piaggio’s designs from other three-wheeled vehicles on the market.

Inadmissible Appeal

The Corte di Cassazione did not delve into the merits of Peugeot’s appeal. Instead, it found the appeal inadmissible due to Peugeot’s requests for new investigations and objections to the grounds of the court of appeal’s ruling. The supreme court’s dismissal effectively reinforced the earlier decisions, confirming that the Italian segment of Piaggio’s European patent had been infringed upon.

Consequences for Peugeot Motocycles Italia

As a result of the infringement, the Milan Court of Appeal has mandated that Peugeot Motocycles Italia pay damages exceeding one million euros. This ruling serves as a significant financial and reputational blow to the company. Additionally, an injunction has been imposed against Peugeot Motocycles Italia, preventing further use of the patented technology.
