In a recent development, the Delhi High Court has overturned its previous decision that granted permission for a widow to terminate her 29-week pregnancy. The court now underscores the right to life of the unborn child and encourages adoption as an alternative.
The 26-year-old woman, currently in her 32nd week of gestation, is advised to undergo delivery at either AIIMS or any Central or State hospital. The woman had sought permission for medical termination in December last year, as her gestation period exceeded 24 weeks, making her ineligible for the procedure without court approval.
The petitioner, who lost her husband in October 2023, decided against continuing the pregnancy and approached the court after being denied medical termination by doctors.
The court, in rejecting the plea for foeticide, suggests adoption as a compassionate alternative, considering the fair chance of survival for the unborn child. The Centre assures support by covering all medical costs and incidental charges associated with adoption.
